Results of February courts-martial released

As part of a pledge last year to be “active, open and transparent” when it comes to sexual assault prevention efforts, the Navy continued its monthly release of all court-martial verdicts, announcing February’s results for all cases, sexual assault-related and otherwise, late last week.

The cases, listed by region:

Naval District Washington

■ At a general court-martial at the Washington Navy Yard, Washington, D.C., AN Dustin Clark was tried for rape, aggravated sexual assault and sodomy. On Feb. 21, the military judge returned a verdict of guilty for rape and sodomy and a verdict of not guilty for aggravated sexual assault. The military judge sentenced him to a dishonorable discharge, reduction in rank to paygrade E-1 and confinement for seven years.

■ At a special court-martial at the Washington Navy Yard, IS3 Kristopher Linton pleaded guilty to unauthorized absence and larceny. On Feb. 12, the military judge sentenced him to a bad conduct discharge, reduction in rank to paygrade E-1, a fine of $12,250 and confinement for three months.

Navy Region Mid-Atlantic

■ At a general court-martial in Norfolk, Va., Lt. j.g. Douglas Varnado pleaded guilty to missing ship’s movement, violation of a general order, false official statement and conduct unbecoming an officer and a gentleman, and was additionally tried for sexual assault. On Feb. 12, the military judge returned a verdict of not guilty to the sexual assault and sentenced him to a fine of $42,000 and confinement for 89 days.

■ At a general court-martial in Norfolk, an O-2 was tried for abusive sexual contact, conduct unbecoming an officer and a gentleman, and drunk and disorderly conduct. On Feb. 18, the military judge returned a verdict of not guilty.

■ At a general court-martial in Norfolk, MM2 Evan R. Tapio pleaded guilty to receipt and solicitation of child pornography. On Feb. 20, the military judge sentenced him to a dishonorable discharge, reduction in rank to paygrade E-1 and confinement for two years.

■ At a general court-martial in Norfolk, EM2 Edward T. Atulu pleaded guilty to abusive sexual contact. On Feb. 26, the military judge sentenced him to a dishonorable discharge and confinement for one year.

■ At a special court-martial in Norfolk, BM3 Brandon L. Ferguson was tried for two specifications of wrongful use of spice. On Feb. 1, a panel of members returned a verdict of guilty to one specification and sentenced him to reduction in rank to paygrade E-2, the forfeiture of $1144 per month for two months, restriction for 30 days and hard labor without confinement for 30 days.

■ At a special court-martial in Norfolk, HM2 Steven Cook pleaded guilty to violation of a general order and indecent language. On Feb. 10, the military judge sentenced him to confinement for 10 months.

Navy Region Southeast

■ At a general court-martial in Pensacola, Fla., ABE2 Alonzo Bass was tried for rape, aggravated sexual assault, abusive sexual contact, aggravated sexual contact, wrongful sexual contact, sexual harassment, forcible sodomy and assault consummated by a battery. On Feb. 28, a panel of members returned a verdict of guilty to sexual harassment, wrongful sexual contact and sodomy. The panel sentenced him to a dishonorable discharge, reduction in rank to paygrade E-1, forfeiture of all pay and allowances and confinement for seven years.

■ At a special court-martial in Pensacola, AR Brandon McKenzie pleaded guilty to unauthorized absence, violation of a general order, wrongful use of marijuana, wrongful appropriation and larceny. On Feb. 11, the military judge sentenced him to a bad conduct discharge and confinement for five months.

Navy Region Midwest

No special or general courts-martial.

Navy Region Northwest

■ At a general court-martial in Everett, Wash., ABE1 Marcelino C. Olivarez pleaded guilty to violating general orders and assaults consummated by battery. On Feb. 28, the military judge sentenced him to a bad conduct discharge, reduction in rank to paygrade E-1 and confinement for 40 months.

■ At a special court-martial in Bremerton, Wash., AOAN Ledarius A. Garrett pleaded guilty to willfully disobeying a superior commissioned officer, insubordinate conduct toward a petty officer and breaking restriction, and was additionally tried for assault consummated by a battery and communicating a threat. On Feb. 12, the military judge returned a verdict of guilty on all charges and sentenced him to reduction in rank to paygrade E-1 and confinement for 120 days.

■ At a special court-martial in Everett, EMFN Dustin B. Shattuck pleaded guilty to indecent exposure. On Feb. 25, the military judge sentenced him to reduction in rank to paygrade E-2, forfeiture of $500 per month for four months, and confinement for 120 days.

■ At a special court-martial in Everett, ATAN Christian D. Wilson pleaded guilty to wrongful possession, introduction with the intent to distribute and use of cocaine, and disorderly conduct. On Feb. 26, the military judge sentenced him to a bad conduct discharge, reduction in rank to paygrade E-1 and confinement for eight months.

■ At a special court-martial in Bremerton, IT3 Christian N. Smith pleaded guilty to wrongful use of marijuana and unauthorized absence. On Feb. 28, the military judge sentenced him to reduction in rank to paygrade E-3, a fine of $500 and confinement for 47 days.

Navy Region Southwest

■ At a general court-martial in San Diego, SH2 Jim Villanueva was tried for two specifications of forcible sodomy. On Feb. 14, a panel of members returned a verdict of guilty to one specification of forcible sodomy. The members sentenced him to a dishonorable discharge and confinement for one year.

■ At a general court-martial in San Diego, an E-6 was tried for rape and assault consummated by a battery. On Feb. 20, a panel of members returned a verdict of not guilty.

■ At a general court-martial in San Diego, CE3 Nathan Karanja was tried for sexual assault and making indecent visual recordings. On Feb. 28, the military judge returned a verdict of guilty to sexual assault and sentenced him to a dishonorable discharge and confinement for 33 months.

■ At a special court-martial in San Diego, CS2 Jeremy Weaver was tried for attempted sexual assault, sexual assault, making false official statements and obstruction of justice. On Feb. 21, a panel of members returned a verdict of guilty to making false official statements and obstruction of justice. The panel of members sentenced him to reduction in rank to paygrade E-4, forfeiture of $1,214 per month for two months and restriction for 45 days.

Navy Region Hawaii

■ At a general court-martial in Pearl Harbor, Hawaii, an E-5 was tried for sexual assault. On Feb. 26, the military judge returned a verdict of not guilty.

Navy Region Japan

■ At a special court-martial in Yokosuka, Japan, CS3 Adrian Aguinaldo pleaded guilty to larceny. On Feb. 25, the military judge sentenced him to a bad conduct discharge, reduction in rank to paygrade E-1, a fine of $10,000 and confinement for 75 days.

Navy Region Europe, Africa, Southwest Asia

■ At a general court-martial in Naples, Italy, HMC Michael Z. Pabelona was tried for theft of military property, false official statements and conspiracy to commit fraud. On Feb. 14, a panel of members returned a verdict of guilty for theft of military property and a false official statement and sentenced him to reduction in rank to paygrade E-5, forfeiture of all pay and allowances, a fine of $60,000, confinement for 60 days and restriction for 60 days.
